General Terms and Conditions


1. General Provisions




I. These terms and conditions define the relationship between our company LaMode Boutique, Voerder Str. 6, DE-58135 Hagen, as the seller and operator of the online store www.lamodee.com, and you, our customer who concludes a purchase contract with us.


II. We treat all customers equally and grant the same rights and benefits regardless of whether they are consumers or not. Therefore, the rules in these terms and conditions apply to all our customers.


III. These terms and conditions apply primarily to purchases made in our online store. They also apply to purchases made via our customer hotline or in one of our physical stores.

2. Formation of the Contract




I. You can conclude a purchase contract with us through the online shop, social media channels, or by telephone.


II. The contract is concluded when you place an order on the website or through customer service, which constitutes an offer to conclude a purchase contract. The order is binding for 7 days. We confirm receipt by email. The contract is formed when we accept your offer by dispatching the goods, and we will inform you of the shipment via email.


III. We only deliver goods in household quantities. In certain cases (especially discounts or sales), we reserve the right to set a maximum delivery quantity.


IV. The presentation of products in the online shop is not a legally binding offer but an invitation to place an order. By clicking the “Pay Now” button, you submit a binding order for the goods in your cart. The confirmation of order receipt follows immediately but does not yet indicate contractual acceptance. We may accept your order by sending an order confirmation via email or by dispatching the goods within two days.

3. Right of Withdrawal




Right of Withdrawal


You have the right to withdraw from this contract within fourteen days without giving any reason.


The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the last item.


To exercise your right of withdrawal, you must inform us (LaMode Boutique, Voerder Str. 6, DE-58135 Hagen, Tel.: 0176 – 62 999 097, Email: la_mode_hagen@hotmail.com) of your decision by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not mandatory.


To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period expires.


Consequences of Withdrawal


If you withdraw from this contract, we will refund all payments received from you, including standard delivery costs (excluding any additional costs resulting from a different delivery method than our standard delivery), without undue delay and no later than fourteen days from the day we are informed of your decision to withdraw.


We will issue the refund using the same payment method used for the original transaction, unless expressly agreed otherwise. You will not be charged any fees for this refund.


We may withhold the refund until we have received the goods back or until you provide evidence that you have returned the goods, whichever occurs first.


You must return the goods without delay and in any case no later than fourteen days from the day you notify us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.


Return shipping costs are the responsibility of the buyer.

4. Exclusion/Expiration of the Right of Withdrawal




The right of withdrawal does not apply to goods that are custom-made based on the customer’s specifications or clearly personalized.

It expires early for sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery.

5. Delivery




I. Delivery is only made in household quantities and only to end consumers.


II. You may choose the payment and delivery method from the available options. Before shipping the order, we will inform you of the selected method and any associated costs.


III. The delivery times stated are estimated based on carrier information and not guaranteed.


IV. We reserve the right to provide free delivery in certain cases.

6. Warranty / Complaints




I. If delivered goods show obvious material or manufacturing defects (including transport damage), please report them immediately to us or the delivery personnel. Failure to report does not affect your legal rights.


II. If the goods are defective upon delivery, compensation in the form of a voucher may be agreed. You also have the right to have the defect remedied by repair or replacement. If defect rectification is impossible or unreasonable, you are entitled to a price reduction or, if the defect is significant, withdrawal from the contract.


III. We are liable for defects appearing within two years of delivery or before any expiry date stated on the packaging.


IV. We strive to display product colors as accurately as possible, but we cannot guarantee exact reproduction due to screen variations.


V. Goods are deemed defective if they lack expected features, do not serve their purpose, do not comply with legal requirements, or are delivered in incorrect quantity. Allergic reactions or personal sensitivities are not considered defects. Promotional or free items are not considered defective. Product images are illustrative and may differ (e.g., packaging changes).


VI. Please send defective products with a completed complaint form to:

VII. We will inform you of complaint progress via email or SMS; we may also contact you by phone.


VIII. Complaints are processed without undue delay and usually within 30 days. If this period is exceeded, you may withdraw from the contract. You may be required to provide reasonable cooperation.


IX. In the case of a justified complaint, we cover the return shipping costs.

7. Payment




Payment methods include PayPal, instant transfer, invoice, Klarna, credit card (Mastercard, VISA, AMEX), or gift card.

No discount is granted for early payment.

We may limit available payment methods depending on creditworthiness.

Payment is authorized through PayPal. The account is charged when the goods are shipped (or immediately for customized goods).


Credit Card

Charged during shipment (or immediately for custom-made items).


Klarna

Offered in cooperation with Klarna Bank AB. Personal data is processed per Klarna’s privacy policy.

8. Prices




All prices are in Euros and include statutory VAT.

Goods remain our property until full payment is received.

10. Alternative Dispute Resolution




We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Contract Language / Storage of Order Data




The contract language is German. The order text is not stored and cannot be retrieved later. You may print your order details immediately after submitting the order.

12. General Information




I. We issue a receipt that is recorded electronically with tax authorities; if technical issues occur, this will be done within 48 hours.


II. The contract is governed by German law.


III. If VAT rates change before contract conclusion or shipment, the price difference must be settled or refunded.


IV. The invoice is sent electronically via email. If a paper invoice is preferred, you may request it and it will be included with the goods.


V. All product prices, including sale prices, apply while stocks last or until updated.
